Terms and Conditions
These Terms govern the contract between you and Ubivo when you purchase a paid location report. By making a purchase you confirm that you have read and understood these Terms.
1. Contracting party
Your contracting party is Ubivo — sole proprietorship Marco Scherer, Switzerland (full provider details in the Legal Notice). The contract is concluded as soon as your purchase has been successfully processed by Stripe and you receive the access confirmation by email.
2. What Ubivo provides
Ubivo is an online information service. From publicly available official data sources (BFS, BAFU, swisstopo, ESTV, ARE, MeteoSwiss, Open-Meteo, among others) we calculate a residential-quality score for a specific Swiss address, as well as individual factors such as noise, commute accessibility, tax and health-insurance burden.
Ubivo does not provide:
- no real-estate brokerage, no valuation of individual properties
- no legal, tax or investment advice
- no guarantee of the availability or price of specific apartments
- no substitute for a personal on-site inspection
3. Products and prices
The free report ("Standard view") is viewable without registration and shows all factors with generic default values. Personalized calculations (door-to-door commute time, exact tax and health-insurance burden, children-age weighting, alternative addresses) are offered as a one-time purchase:
- Dossier (buyers): CHF 79, one-time
Prices are in Swiss francs including any applicable VAT. Payment is processed through Stripe (credit card, Twint once activated). There is no subscription, no recurring charge — each purchase is a one-time piece of information.
4. Immediate provision and waiver of withdrawal
Paid reports are provided digitally immediately after payment is received. By clicking "Buy now" you expressly consent to immediate performance of the contract and waive any right of withdrawal for digital content. This consent is a precondition for the purchase (Swiss Code of Obligations (OR) Art. 40e applied by analogy for digital information services).
5. Refunds
A refund is possible in the following cases:
- technical errors on our side that prevented the report from being provided
- obviously incorrect address recognition, where a calculation was not possible despite payment being received
- duplicate payment caused by technical errors in the Stripe checkout
Dissatisfaction with the content of a correctly provided report (e.g. you do not like the score values or factor selection) is not grounds for a refund, as the contract is fulfilled upon provision. Write to us anyway at hallo@ubivo.ch — we handle hardship cases with goodwill.
6. Scope of use
You receive a non-transferable right to use the purchased report — for private purposes (your own apartment search, purchase decision) without restriction. Any commercial reuse (e.g. resale, embedding into your own advisory products, systematic scraping) requires a separate written agreement.
7. Data basis and quality
Ubivo values are based on publicly available official data sources and mathematical calculation models (FAO-56 for sun exposure, BAFU sonBASE for noise, ESTV tariff tables for taxes, among others). We strive to keep data up to date, disclose a reliability rating for each factor, and mark values that are not yet available as "pending". We give no guarantee for the timeliness, completeness or day-to-day accuracy of the underlying data — the individual sources lie outside our control.
8. Limitation of liability
Ubivo is liable for direct and indirect damages arising from use of the service only in cases of intent and gross negligence. Liability for slight negligence, for consequential damages, lost profit or damages resulting from decisions you make on the basis of an Ubivo report (in particular rental and purchase decisions) is excluded to the extent permitted by law. This limitation does not apply where mandatory law provides for broader liability.
Insofar as Ubivo is liable at all, damages are limited to the amount of the purchase price paid for the respective address — at most CHF 19 for a Quick Check or CHF 79 for a Dossier.
As the buyer, you are obliged to independently assess whether the Ubivo values are sufficient for your specific decision and, where appropriate, to consult further sources, an on-site inspection or professional advice.
8a. Service definition
Ubivo is a data-aggregation and visualization service based on publicly available Swiss data sources (BFS, BAFU, swisstopo, BAG, ARE, ESTV, ElCom, BAKOM, MeteoSwiss, Open-Meteo, among others). Ubivo provides no real-estate valuation, no legal, tax, banking or insurance advice within the meaning of the relevant Swiss legislation. Personalized factor values (e.g. commute time, tax burden, health-insurance premium) are model calculations based on static tariff data and replace neither the official tax/premium assessment nor individual advice from a qualified professional.
8b. Third-party data sources
Ubivo assumes no warranty for the timeliness, completeness or accuracy of data obtained from third parties. Data sources are transparently disclosed on the page /datenquellen with a license note and update status. For data sources with a stated lag ("as of 2018", "as of 2024", etc.) you can assess the change to the present yourself.
9. Availability
Ubivo is operated with great care, however uninterrupted availability (24/7 SLA) is not guaranteed. Maintenance work, technical faults or outages of third parties (e.g. Stripe, Open-Meteo) may cause temporary restrictions. Claims for damages arising from such outages are excluded — see chapter 8.
10. Data protection
We process your data exclusively according to the rules of our Privacy Policy. By making a purchase you also accept it.
11. Changes to these Terms
We may amend these Terms for future purchases. The version authoritative for an individual purchase is the one published on ubivo.ch at the time you click to buy. We actively communicate material changes (a notice on the website, and by email for logged-in buyers).
12. Severability clause
Should any provision of these Terms be or become wholly or partially invalid, the remaining provisions stay in force. The invalid provision shall be deemed replaced by the permissible arrangement that comes closest to its economic purpose.
13. Applicable law and place of jurisdiction
Swiss law applies exclusively, excluding conflict-of-law references and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes is the provider's registered seat (see Legal Notice). Mandatory consumer-protection provisions at the buyer's place of residence remain reserved.
